Peter acts for high-net-worth individuals from the UK and around the world, trustees, protectors, and multinational professional services businesses operating in in this area. Peter has significant experience litigating in both UK and international courts, including Jersey, Guernsey, the BVI, the Bahamas, Hong Kong and Mauritius.

Peter advises on a full range of matters affecting private clients and their structures including:

- applications to deal with mistaken advice or flawed decisions by way of rectification or revocation;

- breach of trust claims;

- fraud claims;

- disputes between family members regarding their interest in family trusts and the operation of underlying corporate entities;

- trustee directions and court approval/blessing applications;

- advice about and disputes involving loss of capacity by family members or fiduciaries;

- challenges to Wills.

Peter has particular expertise resolving difficult and long-running disputes between beneficiaries of both English and offshore family trusts owning large multinational businesses. 

Peter also regularly acts for Trustees of 'commercial trusts' including security trustees on contentious issues arising from secured bonds, securitisations or structured finance transactions as well as trustees of Unit Trusts, EOTs, EBTs involved in disputes or where the underlying structures are financially distressed.

  • Beneficiary succession disputes; disputes between family members regarding their interests in family trusts

    • Acted for a major bank trustee on an application for directions within the context of a blessing application seeking to restructure an offshore trust holding a large family business as part of a major international succession dispute.
    • Advised a beneficiary on a multi-faceted international family succession dispute over a listed company held in an offshore trust with multiple claims being simultaneously litigated in numerous jurisdictions (In the matter of the trusts of the Deed of Settlement establishing the X Foundation Trust - 2019/CLE)
    • Advised a beneficiary of a family trust on a cross-border dispute with other family members and the professional trustees over the partition of a trust holding shares in a large property business founded by the Settlor.
  • Mistake and rectification claims    

    • The Representation of B Corporation 2022/155: Successfully advised a professional trust company on a novel mistake claim in Jersey to set aside a complicated restructuring implemented by a Trustee that triggered inadvertent tax consequences.
    • Advising on the rectification of a Trust Deed holding shares in a family business to correct the intended interests of the beneficiaries.
  • Applications for directions and blessing applications

    Acted for a major bank trustee on an application for directions within the context of a blessing application seeking to restructure an offshore trust holding a large family business as part of a major international succession dispute.

  • Disclosure of trust information  

    Advised a beneficiary and protector on esoteric proceedings in Hong Kong related to a hostile application for disclosure of trust information.

  • Disputes over loss of capacity and powers of attorney

    • Acted for a major international bank trustee in offshore proceedings regarding the validity of a power of attorney in connection with a major family succession dispute.
    • Advised a beneficiary in foreign proceedings challenging the mental capacity of the Protector/Appointor of an offshore trust.
  • Trustee removal applications

    • Successfully advised the UK beneficiaries of an offshore family trust holding a large operating company on a hostile strategy to remove the errant trustees.
    • Successfully advised an African oil and gas tycoon beneficiary on the removal of the professional trustees of an offshore family trust holding a large operating company.
  • Will challenges

    Advised the beneficiary of an UHNW estate on a cross-border will challenge and estate dispute.

  • Fraud and attacks on trusts

    • Acted for Trustees successfully defending and settling an attempt to enforce against the trust assets and 'bust' a trust brought by the settlor's creditors.  
    • Successfully advised an UHNW beneficiary on enforcement claims in respect of fraudulently dissipated trust assets including obtaining a freezing injunction in cross-border proceedings in England and Mauritius.
  • Insolvent trusts

    • Successfully advised the Trustees of an insolvent EOT on the sale of an insolvent underlying operating company and complex restructuring.
    • Advised the security trustee in respect of an insolvent bond programme.
