We have deep industry and sector experience in PFI and public infrastructure, residential, energy transition and renewables, industrial and logistics, and commercial, hospitality and leisure.  We are also experts in public procurement disputes and in resolving disputes across the rail sector, both construction and commercial.

We have extensive experience of the principal standard form contracts, including FIDIC, JCT, NEC, RIBA, ACE, IChemE and IEE, as well as many forms of bespoke contract.

Disputes in PFI and public infrastructure projects can be particularly challenging, given the long-term nature of the contracts, the complex relationships between public and private sector parties and often complex dispute resolution mechanisms. Our team acts for project companies, as well as building and FM contractors, so has experience across the board to assist in resolving these disputes.  We advise in respect of all aspects of these projects including defects, delays, deductions, performance failures, and contract variations.

Recent cases include: 

  • Advised FM provider in a £35m+ dispute over fire safety defects at a major hospital PFI project. Managed complex adjudication and restructuring proceedings, addressing technical and contractual issues.
  • Defending a contractor in a £188m+ PFI dispute involving fire safety and cladding defects across nine social housing towers.
  • Advising a project company on a £2m+ dispute in a PFI schools project, following the discovery of significant defects. We supported on limitation strategy, standstill agreements, and prepared for proceedings against contractors.

  • Advising a contractor on a £10m+ dispute over delays and scope in relation to a major UK transport hub's car park. We addressed issues with significant variations, engineering challenges, and liability for liquidated damages.
  • Advising a property owner in High Court litigation over serious waterproofing defects at a self-storage facility, including claims for remedial costs and lost rental income, and supporting with expert investigations and procurement of necessary repairs.
