Emma's in-depth understanding of the commodities markets makes her a sought-after advisor in London arbitrations and High Court litigation.

Emma's core areas of practice are commodity trading disputes (oil and gas, metals, grains, sugar, and biofuels) and related charterparty, bill of lading, and letter of credit issues, often involving sensitive and complex issues such as fraud. She represents clients in arbitrations under all the major rules (LCIA, ICC, LMAA, GAFTA, FOSFA, RSA and SAL), as well as handling disputes arising out of company or asset disposals/acquisitions, share purchase agreements, and joint venture agreements.

  • International grains trader LMAA arbitration and High Court - off-hire dispute following piracy capture

    Represented successful intermediate charterers in LMAA arbitration and High Court appeal defending a claim by head owners for damages arising out of off-hire payments following the capture of the vessel by Somali pirates in the Arabian Sea.
  • Ukrainian fuel trader LCIA arbitration – ULSD sale contract dispute  

    Represented Ukrainian oil trader in two LCIA arbitrations relating to its sale to a company with Russian links of multiple shipments of Ultra-Low-Sulphur Diesel, including investigating sanctions issues and prospects of ancillary injunctions such as freezing orders in respect of possible fraud claims.

  • Italian multinational energy trader Assistance following Red Sea Houthi attacks 

    Advised Italian oil major following missile attack by Houthi Rebels in the Red Sea in December 2023, including advising on risks/obligations under sale contract and charterparty, general average, and transhipment.
  • Latin American National oil company ICC arbitration sale and purchase dispute

    Represented national oil company in US$50 million ICC arbitration arising out of sale and purchase of subsidiary engaged in on-shore drilling of hydrocarbons.

  • Middle Eastern state-owned oil company Nigerian Court litigation – letter of credit dispute

    Acted for subsidiary of Middle Eastern state-owned oil company in a US$4 million tort claim before the Nigerian Court against a major African bank for alleged negligence in advising a letter of credit.

  • Global fuel trader LMAA arbitrations – ethanol transhipment

    Represented global energy company in concurrent LMAA arbitrations relating to transhipment of ethanol products in Philippines and the subsequent arrest and detention of the cargo and vessels by the Philippine authorities. Successfully resolved via mediation.

  • Metals trader Assistance following collision incident

    Represented seller of a cargo of iron ore following a collision incident in Greek waters. Real-time co-ordination of the activities of salvors, facilitation of transhipment of the undamaged goods and salvage sale of the damaged goods.
  • European grains and oilseeds trader FOSFA arbitration – sale contract default

    Represented European grains & oilseeds trader in the arbitration and appeal of a FOSFA award on jurisdiction with an underlying claim exceeding US$28 million relating to a failure by its buyer to take delivery of multiple shipments of sunflower oil.
  • Global sugar trader RSA arbitration and anti-suit injunction – sugar contract

    Represented world's largest sugar trader in RSA (Refined Sugar Association) arbitration against its Chinese buyer for failing to pay for and take delivery of white crystal sugar. Prepared an anti-suit injunction to go before the English Court following the Chinese buyer seeking a declaration from the Beijing Court that there was no contract between the parties.
  • African-focused mineral sands producer Drafted suite of contracts

    Drafted suite of offtake agreements and charterparties for dual-listed African-focused mineral sands producer.
