Jenny specialises in international contentious trust, probate, succession and high value family disputes.  She also has extensive experience acting in pensions disputes. 

Jenny's client base includes leading international trust companies, private banks, financial services institutions, high-net-worth individuals and protectors. She has significant experience litigating in England, Jersey, Guernsey, Hong Kong, Singapore and the BVI.   

Jenny advises on a full range of matters affecting trustees, protectors, private clients and their advisers including:

- breach of trust claims, often involving allegations of fraud;

- forced heirship claims and challenges to wills;

- contentious partitions of trusts;

- trustee directions and court approval/blessing applications;

- disputes between family members regarding their interests in family structures and the operation of underlying corporate entities, 

- advice about and disputes involving loss of capacity by family members or fiduciaries;

- applications to deal with mistaken advice or flawed decisions by way of rectification, construction or revocation of trust documentation;

- applications for disclosure of information and seeking to hold trustees to account.

  • Zorin Sachak Khan & Others v Gany Holdings (PTC) [Civil Appeal BVIHCMAP 2014/0018]

    Acted for three beneficiaries of a family trust in a claim for an account and removal of a trustee where substantial assets were misappropriated.  Successfully obtained a pre-trial Norwich Pharmacal Order disclosing assets.

  • Theta Investments Ltd v Rysaffe & Others [CL-HC-2014-000840]

    Acted for a trustee defending the validity of an assignment of proceeds of sale into a trust and the validity of the trust.

  • The Representation of B Corporation 2022/155 - Mistake Application

    Acted for a trustee in an application to set aside a transaction and the resulting tax liability.

  • Application to vary a Trust

    Acted for adult beneficiaries in an application to vary family trusts where paternity and beneficial status of a family member was uncertain.

  • Breach of trust claim

    Acted for a trustee in a high value breach of trust claim relating to the purchase of an operating business.

  • Contentious Partition of a significant trust

    Acted for a trustee in a partition of a trust involving multiple applications to court in connection with the validity of documents and issues relating to capacity and undue influence.

  • Probate dispute

    Acted for the partner of a high-profile deceased in connection with a dispute over chattels left to her under the deceased's will.

  • Removal application

    Acted for the trustee in relation to a claim for mismanagement of trust investments and expenses and a claim for removal of the trustee.

  • Negligence claim against tax adviser

    Acted for the trustee in a negligence claim against a firm of solicitors for providing negligent tax advice.

  • Application for Letter of Request

    Successfully obtained an order for a Letter of Request asking the English Court to order the deposition of a partner of a leading law firm to assist in determining the assets of a trust.
