CIF Weekly: Supreme Court rules in FIMBank Plc v KCH Shipping Co Ltd (the "GIANT ACE") [2024] UKSC 38

In a landmark and hotly anticipated decision, the English Supreme Court has upheld the applicability of the one-year time bar under Article III, Rule 6 of the Hague Visby Rules ("HVR") to claims for misdelivery of cargo occurring after discharge.

The judgment, delivered on 13 November 2024, provides crucial clarity on the scope of the HVR and their impact on post-discharge misdelivery claims.
