Tal specialises in all aspects of recovery of assets into insolvent estates by receivers, liquidators, administrators and trustees in bankruptcy (or analogous professionals in overseas jurisdictions), usually involving cross-border issues. Tal also advises international clients and advisors on how to best use insolvency processes and powers as part of a wider global asset recovery toolkit.

She acts in specialist insolvency proceedings and also has significant experience in related litigation under the Companies Acts and the Proceeds of Crime Act. Tal often acts in matters seeking the appointment of receivers by the court, and separately acts for such court-appointed receivers in the course of the exercise of their powers.

In addition to her work for office holders, Tal provides advice to international corporate and individual clients regarding the implications of insolvency for them and members of their supply chain, on the risks associated with acquisitions of businesses and assets from insolvent companies, and on structuring transactions to ensure that they comply with insolvency legislation.

Early in her career Tal spent time working in industry for a market leading asset recovery team, and also completed a secondment in the recoveries team of a clearing bank which gives her a unique understanding of how such clients operate and enables her to better meet their requirements.

Experience

  • Acting for trustees in bankruptcy (UK)

    • Investigating whether the offshore structures financing a UK bankrupt are vulnerable to attack.
    • Of a deceased bankrupt with significant claims against the estate assisting with investigations into where the money has gone including recognition and asset realisations in Switzerland.
  • Acting for liquidators / administrators (UK)    

    • Of a participant in a fraudulent investment scheme bringing misfeasance claims against an offshore de facto director.
    • Of a portfolio of companies which were part of a Ponzi Scheme in bringing claims against multiple third parties located overseas.
    • Of a sanctioned cargo airline with issues arising in UAE, US, Ireland and the UK.
  • Acting for receivers (UK)    

    • Of a large portfolio of assets which involve multiple sets of proceedings in England, the Netherlands, Spain, Marshall Islands, Jersey, Guernsey, Isle of Man and Italy amongst others. 
    • Of a portfolio of assets owned by Cypriot nationals with offshore trust issues.
    • Of commercial property owned by a sovereign for payment of an arbitral award.
  • Foreign Officeholders/Clients      

    • Acting for Irish officeholders obtaining first order post Brexit recognising an Irish examinership in England and giving effect to its scheme pursuant to Irish law - Silverpail Dairy (Ireland) Unlimited Company v. McCarthy [2023] EWHC 895 (Ch)
    • Recognition proceedings (both inbound and outbound) in respect of Ireland, Switzerland, France, Spain, Isle of Man, Brazil, Cayman and others.
    • Acting for Chapter 11 Debtor group to advise on UK subsidiary issues and sale.
    • Acting for Cayman based victims of a Ponzi scheme bringing insolvency proceedings against multiple group companies in England.
    • Acting for Irish liquidators in relation to potential recognition and information production orders.
    • Defence of winding up proceedings and validation order application by French holding company of English start up subsidiary.
