Navigating Dubai Decree No.34 of 2021 - recent developments podcast

For the first time, the DIFC Courts have provided welcome clarification on some of the issues generated by Decree No. 34 of 2021 and the fallout from the abolishment of the DIFC-LCIA and EMAC.

This was provided in the landmark decision of Narciso v Nash, in which members of Stephenson Harwood's Dubai-based disputes team acted for the Claimant. 

Stephenson Harwood partner Mark Lakin, who led the case, recently invited Robert Stephen, former registrar of the DIFC-LCIA and current registrar of Dubai International Arbitration Centre, to discuss the immediate impact of the Decree on arbitration in the region, the status of legacy cases and the operational changes at DIAC. He also shared insights on recent court decisions, including the Narciso case and how DIAC is preparing for the future.
