In an increasingly challenging economic environment, major corporate restructurings and M&A deals involving distressed targets—often acquired by foreign investors—are becoming more common.

This raises the question of whether regulatory constraints on merger control and foreign investments can be compatible with the urgent need to rescue struggling businesses.
