Multi-jurisdictional outsourcing

Technology | 04/03/2025

In a recent Practical Law Practice Note, partner Simon Bollans, managing associate Sarah O'Brien and senior consultant Mark Lewis consider some of the key legal, regulatory, contractual, operational, commercial and other issues that arise in multi-jurisdictional outsourcings.

These include important considerations in the decision to outsource, maximising the benefits and managing the regulatory and contractual risks of cloud computing and fast-emerging technologies like AI, staying compliant with applicable data protection and privacy laws and sectoral regulations like NIS1 and NIS2, the global and local structures used in multi-jurisdictional outsourcings, procurement processes, and service and contractual issues arising in global and local transfers, including in the context of transferring employees and assets.
