Sean has a wealth of experience in supporting project participants – including energy majors, owners, developers, contractors and consultants - in the successful resolution of complex, high-value disputes by international arbitration, as well as by litigation, adjudication, mediation and dispute board proceedings.

Sean also supports clients during project development and execution. This includes the preparation of EPC and other forms of construction contract, and advising on risk management / dispute avoidance and claims under insurance or security.

Sean has benefitted from secondments to leading contractor and insurer clients. He is valued for his approachable and hands-on style, and for providing pragmatic and commercially grounded legal guidance.

Sean has supported clients on major projects and the resolution of disputes across Asia, as well as the Middle East, the UK and beyond. Those projects have included production wells, pipelines, jack-up rigs, FPSOs, LNG terminals, refinery and petrochemical plants, power plants (including coal-fired, combined-cycle, wind, solar and geothermal), water treatment plants, metro tunnels and stations, railways, roads, airports, ports, bridges, sports stadia, data centres and building projects.

Experience

  • Oil Field Facilities Dispute, Indonesia

    Advising energy major owner / operator on BANI arbitrations, seated in Jakarta and subject to Indonesian law, and the successful resolution of high-value engineering, payment and other disputes with a consortium of Indonesian contractors who constructed on-shore production facilities.

  • Refinery & Petrochemical Complex Dispute, Malaysia

    Acting for international contractor in a ICC arbitration and mediation arising from the construction of a refinery and petrochemical complex in Malaysia. Seated in Singapore, Malaysian law governed. Involved high-value engineering, delay related and other disputes, with a successful commercial resolution reached via mediation. 

  • Subsea Oil Pipeline Dispute, Singapore

    Acting for insurers and construction professional insured in a SIAC arbitration against an international oil and gas operator. Involved the successful resolution of complex technical disputes regarding the allegedly negligent decommissioning of a pipeline. Seated in Singapore and subject to Singapore law.

  • Coal Fired Power Plant Dispute, Indonesia

    Acting for international contractor in Dispute Board proceedings and a SIAC arbitration concerning the successful resolution of disputes regarding defects, payment and delay on a project in Indonesia. Seated in Singapore, with contracts governed by both Singapore and Indonesian law.

  • Solar Power Plant Project Advisory, Bangladesh

    Advising owner on project execution in Bangladesh, including in respect of interim entitlements, disputes under a JV agreement, the termination of a contractor and calls on a performance security. English law governed.

  • Metro Project Advisory and Dispute, Singapore

    Advising international contractor JV on risk management and the defective design of tunnel boring machines, culminating in a SIAC arbitration. Seated in Singapore and governed by Singapore law. Substantial security for costs was secured successfully and contributed to a successful final outcome. 

  • Railway Dispute, Thailand

    Acting for international contractor in an ad-hoc arbitration pursuant to the UNCITRAL rules. Seated in Singapore, Thai law governed. Concerned complex jurisdictional and payment disputes under a joint venture agreement in connection with a railway project in Thailand. A successful commercial resolution was ultimately reached via negotiation. 

  • Building Dispute, Malaysia

    Advising international contractor JV on AIAC arbitrations, seated in Malaysia and subject to Malaysian law, arising from delay, payment, engineering and other disputes in respect of the construction of a skyscraper in Malaysia.

  • Theme Park Project Advisory, Korea

    Advising international owner consortium during project execution and on the successful resolution of a final account dispute, including as regards variation and extension of time claims, on a major theme park project in Korea.

  • Wildlife Park Project Advisory and Dispute, Singapore

    Advising specialist subcontractor on the successful resolution of defective design related and other disputes by SOP adjudication and SIAC arbitration, on a wildlife park project in Singapore.
